Acceptance of the terms
Using Kismia AI means you have read these terms and agree to be bound by them. If any part is unacceptable to you, please stop using the service.
Definitions
"Service" means the Kismia AI website and chat. "Companion" means a fictional AI character. "Content" means text, images and audio produced inside the service.
Eligibility
You must be at least 18 years old and legally able to enter into a contract in your country of residence.
Account registration
You agree to provide accurate details when registering and to keep them current. One person may hold one account unless we agree otherwise in writing.
Account security
You are responsible for your login credentials and for everything that happens under your account. Tell us immediately if you suspect unauthorised access.
Fictional nature of companions
Every companion on Kismia AI is generated. Names, photographs, ages and biographies are invented and do not correspond to real people, living or otherwise.
Entertainment purpose
The service exists for entertainment and companionship. It is not therapy, medical care, legal advice, financial advice or an emergency service.
No emergency use
If you are in crisis or facing danger, contact local emergency services or a qualified professional. A companion cannot help in such situations.
Acceptable use
You agree not to use Kismia AI for unlawful activity, harassment of other users, distribution of malware, or attempts to interfere with the operation of the service.
Prohibited content
Requests involving minors, non-consensual scenarios, real identifiable individuals, violence against real persons or illegal goods are strictly forbidden and may be reported to authorities.
Automated access
Scraping, bulk downloading, reverse engineering, or accessing the service through unauthorised scripts and clients is not permitted.
Fair usage
Unlimited plans are subject to reasonable use. Activity that resembles automated load rather than personal conversation may be rate-limited.
Free plan
The free plan includes a limited daily allowance of messages and features. Its scope may change as the service develops.
Paid plans
Paid plans unlock additional messages, memory depth, voice notes and media. Current prices and inclusions are shown on the plans section of the site.
Billing and renewal
Subscriptions renew automatically for the same period until cancelled. The renewal charge is taken on the same day of the following billing cycle.
Cancellation
You may cancel at any time from the account page. Access continues to the end of the paid period and no further charges are taken.
Refunds
Refunds are considered where the service was not delivered as described or where mandatory consumer law requires one. Requests should be sent to support with the transaction details.
Chargebacks
Initiating a chargeback without contacting support first may result in immediate suspension while the dispute is reviewed.
Price changes
We may adjust prices. Existing subscribers are informed before a change takes effect and may cancel prior to the next renewal.
Intellectual property
The Kismia AI name, interface, design, code and companion artwork remain our property or that of our licensors and may not be reused without permission.
Your content licence
You keep ownership of what you write. You grant us a limited licence to store and process it solely to operate the service for you.
Generated content
Replies are produced automatically and may be inaccurate, inconsistent or unsuitable for a given purpose. Do not rely on them for decisions of consequence.
Feedback
If you send suggestions, we may implement them without obligation, payment or attribution.
Third-party links and services
Links to external destinations are provided for convenience. We do not control those destinations and accept no responsibility for their content or practices.
Service availability
We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, updates and technical faults may cause downtime.
Changes to the service
Features may be added, altered or withdrawn. Where a change materially reduces a paid plan, we notify subscribers in advance.
Suspension and termination
We may suspend or close an account that breaches these terms, harms other users, or exposes us to legal risk. Serious breaches may result in termination without refund.
Termination by you
You may delete your account at any time. Deletion removes profile data and stored conversations in line with the privacy policy.
Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid to Kismia AI in the twelve months preceding the claim.
Indemnity
You agree to hold us harmless from claims arising out of your misuse of the service or your breach of these terms.
Force majeure
Neither party is liable for failures caused by events beyond reasonable control, including outages of infrastructure providers and acts of public authorities.
Assignment
You may not transfer your account or your rights under these terms. We may assign the agreement as part of a corporate reorganisation or sale.
Severability
If a provision is found invalid, the remaining provisions continue in force and the invalid part is replaced by the closest lawful equivalent.
Entire agreement
These terms together with the privacy policy form the whole agreement between you and Kismia AI regarding the service.
Governing law and disputes
The agreement is governed by the law of our place of establishment, without prejudice to mandatory consumer protections available where you live. Parties will attempt to resolve disputes informally before formal proceedings.
Updates to these terms
We may revise these terms. Continued use after the revision date shown above means you accept the updated version.
